EU End-of-Life Vehicle Regulation enters force with binding recycled content targets
New rules mandate 25 percent recycled plastic in new cars by 2036 and restrict exports of non-roadworthy vehicles from 2031, aiming to keep critical materials in Europe.
The European Union's new End-of-Life Vehicles (ELV) Regulation entered into force on 13 August 2026, marking the most significant overhaul of automotive circularity rules in a quarter of a century. The legislation replaces the 2000 ELV Directive and the 2005 type-approval directive, introducing binding recycled-content targets, stricter export controls and a redesigned Extended Producer Responsibility framework that will reshape how Europe's 13 million annual vehicle retirements are handled.
Binding recycled plastic targets set a clear timeline
The headline requirement is a phased mandate for recycled plastic in new vehicles: at least 15 percent from 2032, rising to 25 percent from 2036. The European Commission will also establish recycled-content targets for steel and aluminium, expected to apply from 2033. These are not aspirational goals; they are legally binding requirements that vehicle manufacturers must meet to sell in the single market.
The plastic target alone represents a substantial shift. Current recycled plastic content in new European vehicles averages below 5 percent, according to industry estimates. Reaching 25 percent within a decade will require new sorting and reprocessing capacity, consistent material quality standards, and design changes that make plastic components easier to separate at end of life. The Commission's forthcoming implementing acts will define the calculation methodology and whether chemical recycling outputs count toward the target, a point of contention between mechanical recyclers and petrochemical producers.
Design for dismantling becomes a regulatory requirement
Beyond material targets, the regulation tackles the upstream problem: vehicles that are difficult to take apart. Manufacturers must now design vehicles to facilitate dismantling, component removal, reuse and recycling. They must also provide detailed information on how components can be removed and replaced, a measure aimed at recyclers and independent repair operators who have long complained about opaque fastening systems, glued assemblies and proprietary connectors that make recovery uneconomic.
This design mandate extends to critical raw materials. The regulation specifically highlights aluminium, copper and rare earth elements, materials concentrated in electric motors, power electronics and wiring harnesses. Improving recovery rates for these elements is essential to the EU's Critical Raw Materials Act, which sets a 2030 benchmark of 25 percent of annual consumption from recycling. Today, rare earth recovery from end-of-life vehicles is negligible; most magnets are shredded with the steel fraction and lost.
Export restriction closes the 'used vehicle' loophole
From mid-2031, only roadworthy vehicles, defined as those with a valid periodic technical inspection certificate, may be exported outside the EU. The measure targets a long-standing practice: end-of-life vehicles declared as 'used' and shipped to Africa, the Middle East and Eastern Europe, where they often re-enter circulation with minimal safety or environmental oversight. The United Nations Environment Programme estimates that 80 percent of used vehicles exported to developing countries fail basic environmental or safety standards.
The restriction will force Member States to tighten inspection regimes at ports and border crossings. Customs authorities will need access to vehicle registration and inspection databases in real time. Several countries, including the Netherlands and Belgium, have already piloted such systems at Rotterdam and Antwerp; the regulation makes this an EU-wide obligation.
Extended Producer Responsibility gets teeth
The regulation strengthens Extended Producer Responsibility (EPR), requiring vehicle producers, or their authorised representatives, to bear the financial and organisational responsibility for collecting and treating end-of-life vehicles. This includes covering the net costs of collection, depollution, dismantling and recycling when the value of recovered materials does not cover the process. Producers must also meet minimum collection targets: 95 percent of end-of-life vehicles by average weight per year, with at least 85 percent reuse and recycling and 95 percent reuse and recovery.
The EPR framework addresses a persistent gap in the 2000 Directive: orphan vehicles whose manufacturer no longer exists or cannot be identified. Under the new rules, a collective financial mechanism funded by all producers will cover these cases, preventing the cost from falling on municipal waste systems or the last registered owner.
Traceability and digital product passports
Improved traceability is a cross-cutting theme. The regulation introduces clearer criteria to distinguish genuine used vehicles from end-of-life vehicles at the point of transfer, supported by digital records that follow the vehicle through its life. This aligns with the Ecodesign for Sustainable Products Regulation, which will require digital product passports for vehicles, embedding data on material composition, hazardous substances and dismantling instructions accessible to authorised treatment facilities.
For recyclers, the passport could solve a chronic information deficit. Today, an authorised treatment facility (ATF) often receives a vehicle with no knowledge of where high-value components, battery modules, rare-earth magnets, aluminium castings, are located or how to extract them without damage. Standardised, machine-readable data could raise the value of recovered fractions by 15 to 20 percent, according to a 2024 Joint Research Centre study.
Investment signal for European recycling infrastructure
The combination of binding targets, design requirements and EPR financing is intended to de-risk investment in recycling capacity. Europe's automotive shredder residue, the mixed fraction left after metal recovery, still amounts to roughly 3 million tonnes annually, much of it landfilled or incinerated. Meeting the 2036 plastic target alone will require an estimated 1.5 million tonnes of additional high-quality recycled polymer output, implying new sorting lines, washing plants and compounding facilities.
Steel and aluminium targets, still to be defined by the Commission, will add further demand. The European Steel Association (EUROFER) has argued that scrap availability, not demand, is the constraint: Europe exports roughly 18 million tonnes of ferrous scrap annually. Keeping more of that scrap within the EU, upgraded to grades suitable for automotive flat products, would reduce reliance on primary production and its associated emissions.
