Apple blocks live translation AirPods in EU over DMA dispute
The company says a March European Commission decision on interoperability forces it to withhold the feature from European users, but the Commission insists the rules do not prevent product launches.
Apple's newest AirPods can translate conversations in real time, piping the output directly into the wearer's ears. The feature was one of the headline capabilities shown off at the company's iPhone event on Tuesday. But Europeans will not get it. A support page published the same day states that live translation with AirPods is unavailable if the user is in the European Union and their Apple account region is also in the EU. The company attributes the restriction to its reading of obligations under the Digital Markets Act, specifically a European Commission decision adopted in March.
The March decision that changed Apple's calculus
The Commission's March ruling designated Apple's iOS as a core platform service under the DMA and imposed interoperability requirements on a range of system-level functions. The decision requires Apple to allow third-party devices and services to work with features such as notifications, file transfer and device pairing on terms that are fair, reasonable and non-discriminatory. Apple's interpretation appears to be that live translation, because it relies on the tight integration of AirPods with Apple Intelligence on the iPhone, falls within the scope of functions that must be opened to competitors. Rather than build the interoperability layer, the company has chosen to switch the feature off for the entire EU.
The Commission decision, published as a formal specification proceeding under Article 6(7) of the DMA, gave Apple six months to comply. That deadline falls in September, coinciding with the new product cycle. Apple's support page does not cite the specific article of the decision, but the timing suggests the company is treating the specification as a binding constraint on any new AI-driven feature that couples proprietary hardware with the iOS platform.
A pattern of regulatory brinkmanship
This is not the first time Apple has signalled it would withhold services from European users rather than adapt to the DMA. In June, senior executives told analysts that the rollout of Apple Intelligence, the company's generative AI suite, could be delayed or limited in the EU because of "regulatory uncertainties" linked to the same interoperability rules. The company subsequently confirmed that Apple Intelligence would launch in the EU but with a reduced feature set, omitting capabilities that it deemed incompatible with the Commission's requirements. The AirPods translation block follows the same logic: a new AI feature, dependent on proprietary silicon and software integration, is treated as a potential DMA liability.
The strategy carries commercial risk. The EU represents roughly 450 million potential customers and accounts for an estimated 20 to 25 per cent of Apple's global revenue. Withholding a marquee feature from that market hands a marketing advantage to rivals such as Samsung and Google, both of which offer on-device translation on their own earbuds and phones without similar restrictions. It also fuels the narrative, promoted by the Commission and by consumer groups, that Apple uses regulatory compliance as a lever to protect its ecosystem lock-in.
What the Commission actually said
The European Commission's response was unusually direct. A spokesperson said the decision was made unilaterally without consultation and that the Commission is "not able to understand the nature of Apple's concerns." The spokesperson added that the DMA does not impede the launch of new products in EU markets and that, to the contrary, it preserves innovation and freedom of choice. The statement reflects frustration in Brussels at what officials see as a deliberate misreading of the rules. The DMA's interoperability provisions are designed to prevent a gatekeeper from using its control over a core platform service to exclude competing products, not to stop the gatekeeper from launching its own new features.
Legal specialists in EU competition law suggest Apple's position is vulnerable. The DMA requires interoperability on fair, reasonable and non-discriminatory terms. It does not require a gatekeeper to open proprietary AI models to competitors, only to allow rival devices to connect to the platform functions that enable those models to work. If live translation is simply an application that calls Apple Intelligence APIs, the interoperability obligation would attach to the API layer, not to the translation feature itself. Apple's decision to block the feature entirely rather than document the relevant APIs looks, to many observers, like a strategic choice rather than a legal necessity.
Consumer impact and competitive consequences
For European consumers, the immediate effect is straightforward: a feature demonstrated on stage in Cupertino will not work on devices bought in Paris, Berlin or Milan. The languages supported at launch, English, French, German, Portuguese and Spanish, cover the majority of EU citizens, making the omission more conspicuous. Italian, Japanese, Korean and Chinese are promised by the end of the year, but the EU block applies regardless of language. Users who travel to the EU with a non-EU Apple account may find the feature works until they cross a border, at which point the region check disables it.
The competitive dimension is harder to quantify. Samsung's Galaxy Buds and Google's Pixel Buds both offer real-time translation, though they rely on cloud processing rather than purely on-device models. Apple's selling point is privacy: the translation runs locally on the iPhone's neural engine, with no audio leaving the device. If Apple can demonstrate that on-device translation is technically feasible without opening its AI stack, the Commission may face pressure to clarify that the DMA does not require disclosure of model weights or inference pipelines. Until that clarification arrives, the feature remains in regulatory limbo.
The interoperability requirement explained
The March decision focused on nine categories of connectivity: peer-to-peer Wi-Fi, Bluetooth pairing, near-field communication, ultra-wideband, device discovery, file sharing, notification sync, call handover and audio switching. Live translation uses Bluetooth pairing and audio switching to route the translated stream to the AirPods. The Commission's specification requires Apple to publish the protocols and APIs that enable these functions so that a third-party headset manufacturer can implement them. Apple argues that the translation feature itself, because it is powered by Apple Intelligence, constitutes a new system-level function that would also need to be opened. The Commission disagrees, viewing translation as an application that sits on top of the already-specified connectivity layer.
This disagreement goes to the heart of the DMA's architecture. The regulation distinguishes between core platform services, the operating system, the browser, the app store, and the applications that run on them. Gatekeepers must ensure interoperability for the former but retain intellectual property rights over the latter. Where the line falls for AI features that are baked into the OS but delivered through proprietary hardware is untested. The AirPods case may become the first significant test of that boundary.
