EU moves to lift drone pesticide ban despite wider omnibus deadlock
Agriculture ministers have backed broader drone spraying rights, but the reform is trapped in a contentious food safety package that may not survive the autumn.
European farmers can watch the latest spray drones at any major agricultural fair, but they cannot legally operate them over their own fields. A 2009 directive on the sustainable use of pesticides prohibits aerial application, a rule written for crop-dusting planes and helicopters long before battery-powered multi-rotors entered the market. The European Commission now wants to change that, and agriculture ministers have signalled they are ready to agree. The catch is that the reform has been folded into a sprawling food and feed safety omnibus that is stalled on far more controversial grounds.
A ban designed for a different era
The 2009 Sustainable Use of Pesticides Directive was crafted to limit spray drift, environmental contamination and worker exposure from conventional aerial spraying. Drones were not part of the regulatory imagination. In practice, member states can grant derogations only where ground application is impractical or dangerous: the steep terraced vineyards of the Douro, apple orchards clinging to South Tyrolean slopes, or flooded rice paddies where tractors bog down and backpack sprayers put workers at greater risk. The process is cumbersome, each case requiring national authorisation backed by a risk assessment that few authorities have the expertise to evaluate.
That framework has left Europe watching from the sidelines as agricultural drones moved from novelty to standard equipment in the United States, Brazil, China and Japan. At the Commission's agriculture directorate, officials acknowledge that the technology is the one most held back by the current rules, even though it could contribute to more sustainable pesticide use. The contradiction is not lost on Christophe Hansen, the Commissioner for Agriculture and Food, who wrote on Bluesky this week that Europe has the talent and technology to lead in digital agriculture but needs to ensure farmers actually benefit from it.
The precision argument
Proponents argue that drones do more than replace tractors on difficult terrain. Equipped with multispectral cameras and AI-driven analytics, they can scan fields for pest outbreaks and water stress days before the human eye detects them. When they do spray, they target only the affected zones, reducing the volume of active substance applied. CropLife Europe, the pesticide industry association, points out that drones are primarily battery-powered, offering a lower-emissions alternative to diesel tractors. The Czech Agriculture Ministry, which has been among the loudest voices for reform, puts it plainly: drones are tools that can help reduce the amount of products applied, limit their impacts on non-target organisms, and at the same time maintain competitive agricultural production.
The economic case extends beyond chemical savings. Precision application cuts labour costs, reduces soil compaction from heavy machinery, and allows treatment of fields too wet for ground rigs. For high-value crops such as fruit, vines and hops, the return on investment can be measured in weeks rather than seasons. Yet the Commission's own impact assessment concedes that important knowledge gaps remain. It is not yet clear how far pesticide droplets drift from a drone's downward-facing nozzles under different wind and temperature regimes, nor which airframe and nozzle combinations deposit chemicals most accurately. The paradox is that current restrictions make it difficult to gather the very data needed to close those gaps.
From member state pressure to Commission proposal
The push for a dedicated legal framework did not originate in Brussels. In December 2024, fifteen capitals, including Prague, Warsaw, Vienna and Lisbon, wrote to the Commission asking for a standalone proposal on agricultural drones. The Czech presidency had already tried once before: an earlier reform attempt became collateral damage in the political battle over the bloc's pesticide reduction law, which was eventually shelved in 2024. This time, the Commission chose to embed the drone provisions inside its food and feed safety omnibus, a package that touches everything from maximum residue levels to the approval renewal process for active substances.
The strategy has a certain logic. The omnibus is a legislative vehicle; attaching a widely supported measure to it increases the chances of adoption. But it also means the drone reform is now hostage to provisions that have triggered fierce resistance. Among the flashpoints: unlimited approval renewals for all but the most hazardous active substances, and a proposed ban on agricultural imports containing even trace amounts of pesticides prohibited in the EU but legal in the United States. Neither the Council nor the Parliament has found a compromise on those issues, and the Irish presidency, which took over the Council rotation in July, has yet to articulate a clear path forward.
Environmental caution, not opposition
Environmental groups have not mounted the kind of campaign they wage against glyphosate or neonicotinoids. Their concern is procedural: regulators should move more slowly before authorising drone spraying for broad categories of pesticides, given the unsettled science on drift and deposition. There are also secondary worries. Drones generate granular geospatial data on crop health, pest pressure and input use. Who owns that data, and whether it could be used to disadvantage smaller operators who cannot afford the technology, are questions the current proposal does not answer. Critics also note that the upfront cost of a professional spray drone, typically €20,000 to €50,000 plus sensors and software, risks widening the gap between large, capitalised farms and smaller family holdings.
Those concerns have not deterred capitals. In May, the Council agreed to give governments more immediate freedom to authorise drone spraying, provided the risk is deemed no greater than ground-based application. The Commission would prefer to issue technical guidelines first, but ministers opted for speed. The Parliament's agriculture committee has not signalled strong opposition either, suggesting the drone provisions could pass with minimal debate when the omnibus reaches a plenary vote this autumn, if it reaches a vote at all.
The omnibus trap
The procedural reality is blunt: the omnibus must be adopted as a single package. There is no mechanism to carve out the drone chapter and advance it separately. If the Irish presidency cannot broker a compromise on the contentious provisions, particularly the import residue rules that have drawn sharp criticism from Washington and Ottawa, the entire file could collapse. That would leave the 2009 ban intact and force member states back to the derogation route they have been trying to escape for a decade. The Commission would then face a choice: table a standalone drone regulation, restarting the legislative clock, or wait for the next omnibus cycle.
Diplomats in Brussels describe the mood as frustrated. The drone reform is the rare piece of agricultural policy that commands cross-party, cross-regional support. Southern member states want it for steep permanent crops; northern and central members see it as a precision farming tool for row crops; the Commission frames it as a flagship of its digital agriculture strategy. Yet it may fall victim to a fight over import tolerances and active substance renewals that has little to do with uncrewed aircraft.
What the proposal actually changes
Under the Commission's text, member states would be empowered to authorise drone spraying for any crop and any authorised pesticide, provided a risk assessment demonstrates that the operation poses no greater risk to human health or the environment than ground-based application. The assessment would need to account for drift, bystander exposure, biodiversity impacts and the specific drone-platform and nozzle combination used. The Commission would develop harmonised technical guidelines within two years of the regulation entering into force, but national authorisations could begin immediately. The Council's May position goes further, allowing governments to skip the wait for EU guidelines entirely.
